Legal Intercept Statistics

By virtue of Article 127/1, § 7 of the Act of 13 June 2005 on electronic communications, service or network providers have to submit statistics regarding that Article to the BIPT*.

* § 7. Each year, the Institute shall send to the Minister and to the Minister for Justice statistics about the provision to the authorities of data stored by virtue of Articles 122, 123, 126, 126/1, 126/3 and 127. Each year, said Ministers shall forward those statistics to the Chamber of Representatives. Those statistics specifically comprise: 1° the cases in which stored data have been provided to the competent authorities in accordance with the applicable legal provisions; 2° the time passed between the day the data were stored and the day on which the competent authorities requested the transmission of those data; 3° the cases in which requests for stored data, could not be granted. Those statistics shall not include any personal data nor confidential information. Data relating to the implementation of the second subparagraph, 1° are also added to the report submitted by the Minister for Justice to Parliament in accordance with Article 90decies of the Penal Code. The Institute shall ask the operators and the department designated by the King for the information on the basis of which it can fulfil the obligation referred to in the first subparagraph.
